DMCA Copyright Policy – Rohman Hardware
In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy regarding copyright infringement. Rohman Hardware reserves the right to:
- Block access to or remove material that we believe infringes on copyrighted content and has been illegally copied or distributed by any of our advertisers, affiliates, content providers, members, or users.
- Remove and discontinue service for repeat offenders.
Your use of rohmanhardware.com services is subject to our Terms of Service, which include this Copyright Dispute Policy. Any terms used here that are not defined have the meanings given in the Terms of Service.
Reporting Copyright Infringements
If you believe that material or content on or accessible through our Services infringes your copyright (or the copyright of someone you are authorized to act on behalf of), please send a notice of infringement to our Designated Agent with the following information:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work(s) claimed to have been infringed.
- Identification of the material that is claimed to be infringing, including sufficient detail to allow us to locate it.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Contact information for the notifier, including address, phone number, and email if available.
- A statement made under penalty of perjury that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
Response to Proper Infringement Notices
Upon receiving a valid notice of copyright infringement, Rohman Hardware may:
- Remove or disable access to the infringing material.
- Notify the content provider accused of infringement that we have removed or disabled access to the material.
- Terminate the content provider’s access to the Services if they are determined to be a repeat offender.
Counter-Notice Procedure
If a content provider believes that material removed (or disabled) is not infringing, or that they have the right to post the material, they may submit a counter-notice to our Designated Agent including:
- A physical or electronic signature of the content provider.
- Identification of the material that was removed or disabled and its location before removal.
- A statement that the content provider believes the material was removed due to mistake or misidentification.
- Contact information including name, address, phone number, and email if available.
- A statement consenting to the jurisdiction of the court in the judicial district where the content provider is located (or, if outside the US, any court where rohmanhardware.com is located), and agreeing to accept service of process from the party who filed the original infringement notice.
If a valid counter-notice is received, Rohman Hardware may, at its discretion, forward a copy to the original complainant. Unless the copyright owner files an action seeking a court order against the content provider, the removed material may be restored within 10–14 business days after receipt of the counter-notice.
